Employment Screening Providers ("ESP") is committed to safeguarding your privacy. This policy outlines how ESP handles and protects the personal information you provide on our   website and through related ESP services.

Use of the Site

You may use the Site only for lawful purposes and in accordance with the Terms. Any use of the Site or any contents on this Site shall be at your own risk, and we accept no liability based on your use of the Site.

  • Circumvent, manipulate or otherwise attempt to breach any security features or authentication measures we may use to prevent or restrict access to the Site or portions thereof;

  • Upload or distribute any virus, Trojan horse, time bomb or other malicious code or technologies that may damage, interfere with or harm, or attempt to damage, interfere with or harm, the Site, the operation of the Site or the interests of property of its users;

You are responsible for obtaining access to the Site, and such access may involve third-party fees, such as internet service provider or airtime charges. You are responsible for those fees. In addition, you must provide and are responsible for all equipment necessary to access the Site.

Information Collection - What Personal Information Do We Collect

When you visit the ESP  website, you do so anonymously, and we do not collect personal information such as your email address without your consent.

Occasionally, we may ask you to voluntarily provide "Personal Information," which may include your name, email address, phone number, and postal address. This information may be requested for purposes such as correspondence, registration, or participating in an online survey. We will not share this information with any third party without your explicit written consent and will take reasonable measures to protect it from unauthorized access or disclosure.

We may also collect "Navigational Information" through your interactions with the website. While Navigational Information may or may not be linked to you personally, when combined with other data, it can become Personal Information.

Personal information for background checks may be transferred outside the United States, with all data transmitted and stored securely. Passport numbers, unique identification numbers, and dates of birth are not sent overseas except to  verify providers when possible. If a local firm must be used, they will provide local contact information. Any necessary foreign research firms will be vetted and will redact unnecessary information.

Alabama-Specific Compliance

  • Data Breach Notification: In the event of a data breach, we will notify you in accordance with the Alabama Data Breach Notification Act, providing details about the breach and the measures taken to address it.

  • Social Security Number Protection: We comply with the Alabama Social Security Number Protection Act by ensuring Social Security numbers are protected from unauthorized access and use.

Your State Privacy Rights

Numerous state and international comprehensive consumer privacy laws (e.g., European Union, California, Connecticut, Tennessee, etc.) may provide their residents with additional rights, including the right to access, correct, delete, modify or opt-out of the collection of your personal information.

This section applies specifically to residents of certain jurisdictions such as: Texas, Florida, Montana, New Hampshire, Oregon, Utah, Connecticut, Virginia, Iowa, Indiana, Delaware, New Jersey, Kentucky, Colorado and any other state that may enact applicable data privacy laws.

Separate from CCPA, California’s “Shine the Light” law gives California residents the right to ask companies what personal information they share with third parties for those third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the purpose of direct marketing their goods or services to you unless you request such disclosure. ESP respects the privacy of individuals and clients involved in our services, including background checks. We collect, store, and use confidential information in accordance with best practices and applicable laws, including FCRA.

Data Retention

For users that submit contact information on the website, we store the personal information they provide in the form as long as it serves a sufficient business purpose and is permitted by law. Users opt-in to the collection of their personal information by submitting a contact us request.

Opting Out of Communications and Updating Your Information

We only wish to communicate with you if you desire. To opt out of communications, please contact us as detailed below. Every email from ESP will include instructions to unsubscribe. If you wish to update or correct your contact information, please reach out to us. Note that it may take up to 30 days to remove your details from our communication lists.

Links to Other Sites

Our website may link to external sites over which we have no control. ESP is not responsible for the privacy practices or content of third parties. We recommend reviewing the privacy policies of those sites directly.

Do Not Track Signals

As the “Do Not Track” (DNT) standard is not finalized, our website is not compatible with DNT.

Security

We implement reasonable measures to protect Personal Information, but no system can be guaranteed 100% secure. We may use third-party cloud service providers with standard, non-negotiable security measures. Exercise caution when submitting Personal Information, especially over public networks. If you suspect a security issue, please notify us and consider placing orders by phone or in person.

Children Under the Age of 16

Our website is not intended for children under 16 years of age. Persons under age 16 may not provide any personal information to or on the website. We do not knowingly collect personal information from persons under the age of 16. We may change, suspend or discontinue any parts of or the entire Site at any time, including the availability of any product, service, feature or content. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site or any part thereof. Unless explicitly stated otherwise, any modifications to the current Site shall be subject to these Terms and Conditions.

ESP may update this privacy policy periodically. Changes will be posted on our website. Please review the policy before providing any Personal Information. The policy was last updated on the date indicated at the top of this page.

Indemnity

You agree to indemnify and hold harmless the Site Manager, its affiliates and their respective directors, managers, officers, shareholders, members, agents, employees, and licensors (the “Indemnified Parties”) from any claim, suit, demand, liabilities, losses, settlement, judgement, damages, costs and expenses (including reasonable attorneys’ fees) (“Claims”) made by any third party due to or arising out of (i) your use or misuse of the Site, (ii) your connection to the Site, (iii) your violation of these Terms and Conditions, (iv) your violation of any law or the rights of a third party or (v) content you submit, post, transmit or otherwise make available through the Site. The Indemnified Parties Shall be entitled to participate in the defense of any such Claim without waiving or reducing any of your obligations under this Section. You shall also indemnify the Indemnified Parties for any expenses incurred for enforcing this Section.

Remedies

We reserve the right, without limiting any other remedies available to us, to take appropriate legal action for any illegal or unauthorized use of the Site.

Statute of Limitations

No claim shall be brought against the Site Manager more than one (1) year after the earliest of your (i) last use of the Site, (ii) the date the claim arises or (iii) the termination of these Terms and Conditions. The foregoing time period shall not operate to extend any applicable statute of limitations on such claim.

Governing Law

There Terms and Conditions any disputes arising out of or related to the Site shall be governed by and construed and enforced in accordance with the laws of the State of Alabama, without reference to its conflict of laws principles, and, by using the Site, you consent to the jurisdiction of the state and federal course located in Shelby County, Alabama.
